
The City of Capitola will be holding its General Municipal Election on Tuesday, November 6, 2012, to be consolidated with the Presidential General Election. The following information is provided to answer general questions regarding the city’s election. Further information regarding Capitola’s election should be directed to the City Clerk Office’s by calling 831-475-7300.
OFFICES TO BE FILLED BY ELECTION
Two (2) Members of the City Council (4 year terms)
One (1) City Treasurer (4 year term)
INCUMBENTS PRESENTLY HOLDING OFFICE
Council Members Kirby Nicol and Dennis Norton
City Treasurer Jacques Bertrand
(NOTE: Kirby Nicol will not be able to seek re-election due to term limits.)
SALARIES FOR ELECTED OFFICIALS
Members of the City Council also serve as a Director of the Capitola Redevelopment Agency.
Members of the City Council receive $500.00 per month, plus reimbursement for for Council Member expenses.
Directors of the Redevelopment Agency receive $30.00 per meeting attended (up to four meetings per month).
The City Treasurer receives $250.00 per month, plus reimbursement for City Treasurer expenses.
QUALIFICATIONS FOR CANDIDATES
A person is eligible to hold office if he/she is a United States citizen, 18 years of age or older, and is a registered voter residing within the City of Capitola city limits at the time the nomination papers are issued. Verification will be required prior to issuing nomination papers.
FILING FEES - There will be no filing fees for taking out nomination papers.
DATES AND PROCEDURES FOR TAKING OUT, CIRCULATING AND FILING
NOMINATION PAPERS
Monday, July 16, 2012 to Friday, August 10, 2012 at 5:00 P.M.
Nomination papers may be taken out and filed with the Capitola City Clerk during this period. Not less than 20 nor more than 30 valid signatures are required for nomination to elected office in the City of Capitola.
A nomination paper may be circulated and subsequently filed by the candidate or by any other person registered to vote at the election. The circulator is required to indicate by affidavit the dates between which all signatures were obtained.
Nomination papers shall be filed with the Capitola City Clerk not later than 5:00 P.M. on the 88th day (Friday, August 10, 2012 before the election. A candidate may withdraw his/her nomination paper after it has been filed until 5:00 P.M. on the 88th day, but not after then.
TIME EXTENSION IF INCUMBENT FAILS TO FILE
Should an incumbent fail to file by 5:00 P.M. on the 88th day, the voters shall have until 5:00 P.M. on the 83rd day (Wednesday, August 15, 2012) to nominate candidates other than the incumbent for such elective office.
BALLOT ORDER FOR CANDIDATES NAMES
On Thursday, August 16, 2012, at 11:00 a.m., the Secretary of State conducts the randomized alphabet drawing to determine the order in which the candidates will appear on the ballot for the election.
PROCEDURES FOR FILING CANDIDATES’ STATEMENTS, FINANCIAL
DISCLOSURE STATEMENTS, AND CAMPAIGN EXPENDITURE FORMS
Candidates’ Statements, if desired, must be filed with the nomination papers and shall remain confidential until expiration of the filing period. The candidate is responsible for printing costs of the statement in the Sample Ballot. The cost is determined by the County Elections Department and will be collected at the time a candidate files nomination papers. Should a candidate also desire his/her statement to appear in the sample ballot in Spanish, the candidate will pay for the additional cost.

Statements of Economic Interest - A Candidates’ Statement of Economic Interest (Fair Political Practices Commission Form 700) is required to be filed at the time nomination papers are filed.
Campaign Statements - Every candidate for any elective office and every committee must file campaign statements. Before a candidate for elective office can solicit or receive contributions, he or she must file the Form 501 (Statement of Intention). A Form 410 (Statement of Organization) is required to be filed within 10 days of receiving $1,000 in contributions.
ETHICS TRAINING
As an elected official who receives compensation, salary, stipend, and/or reimbursement for expenses, Council Members and the City Treasurer are required to receive ethics training every two years while in office. (Assembly Bill 1234)
